Year-Round Lawn Maintenance Agreement
Effective Date: September 27, 2026
This Year-Round Lawn Maintenance Agreement (“Agreement”) governs enrollment in the recurring Year-Round Lawn Maintenance Plan offered by Brian’s Lawn Service (“BLS”).
By electronically accepting this Agreement and completing enrollment, the customer agrees to the following terms.
1. Service Term
The initial service term is 12 months, beginning on the date the customer completes enrollment and the first scheduled payment is successfully processed.
The plan is paid in 12 equal monthly installments.
2. Automatic Renewal
IMPORTANT: THIS AGREEMENT AUTOMATICALLY RENEWS.
At the end of the initial 12-month term, this Agreement will automatically renew for successive 12-month terms unless the customer cancels automatic renewal before the beginning of the next renewal term.
Brian’s Lawn Service will provide the customer with written or electronic notice of the upcoming automatic renewal no less than 30 days and no more than 60 days before the deadline for preventing automatic renewal.
The renewal notice will clearly state that the Agreement will automatically renew unless canceled and will provide instructions for preventing renewal.
A customer may prevent automatic renewal at any time before the applicable renewal deadline through the online cancellation method provided by Brian’s Lawn Service.
Canceling automatic renewal prevents a new 12-month term from beginning. It does not end or modify the customer’s obligations under the current 12-month term.
3. Seasonal Service Frequency
The standard Year-Round Lawn Maintenance Plan includes:
Weekly service from March through September
Bi-weekly service from October through February
Weekly service generally means service approximately every seven days. Bi-weekly service generally means service approximately every fourteen days.
A specific weekday is not guaranteed. Service dates may reasonably change because of weather, wet turf, holidays, route scheduling, equipment issues, unsafe property conditions, or other circumstances affecting the ability to perform the work properly.
A weather or scheduling delay does not automatically create an additional service visit or refund. Brian’s Lawn Service will make reasonable efforts to complete scheduled service as soon as conditions permit.
4. Standard Lawn Maintenance
Unless otherwise stated in the customer’s written quote, standard recurring service includes mowing, string trimming, edging applicable hard surfaces, and blowing paved and serviced areas clean after completion.
Shrub or hedge trimming, leaf cleanup, storm cleanup, debris removal, hauling, fertilization, herbicide or pesticide treatment, irrigation work, landscape installation, mulch, rock, and other services are not included unless separately quoted and accepted.
5. Initial Lawn Condition
The recurring plan price assumes the property is at a normal maintenance height and in reasonably serviceable condition when recurring service begins.
If the first service requires unusual overgrowth reduction, excessive debris removal, multiple additional cutting passes, or other work materially beyond normal recurring maintenance, Brian’s Lawn Service will disclose any additional charge before performing that additional work.
6. Monthly Billing
The customer agrees to the monthly plan price displayed in the customer’s written quote and enrollment checkout.
The monthly charge represents one of 12 equal installments toward a full year of seasonally adjusted lawn maintenance. It does not represent payment for a particular number of lawn visits during an individual calendar month.
Because calendar months contain different numbers of weeks and service frequency changes seasonally, some months may contain more service visits than others while the monthly payment remains the same.
The customer authorizes Brian’s Lawn Service and its payment processor to automatically charge the payment method provided during enrollment each month.
The agreed monthly plan price will remain unchanged during the current 12-month term unless the customer requests additional work or the size or scope of the property materially changes. Any resulting change to the recurring plan price must be disclosed to and accepted by the customer.
7. Property-Specific Standard Service Rates
As part of each customer’s quote or enrollment record, Brian’s Lawn Service may disclose the standard weekly and bi-weekly per-service rates applicable to that property.
These rates are used to establish the value of services completed if the customer terminates the current 12-month service term before it is completed.
These standard rates do not change the customer’s agreed monthly payment while the customer completes the Year-Round Lawn Maintenance Plan.
8. Early Termination During a Current 12-Month Term
A customer may request to end lawn service before the current 12-month term has been completed.
Because the monthly plan spreads the cost of higher-frequency growing-season service across the entire year, early termination is subject to a service reconciliation.
Upon early termination, Brian’s Lawn Service will calculate the value of lawn services already completed using the property-specific weekly and bi-weekly standard service rates disclosed when the customer enrolled.
Payments already received under the monthly plan will be credited against that amount.
If the value of services already completed exceeds payments received, the remaining difference will be due.
If payments received exceed the value of services already completed, the applicable difference will be refunded or credited.
Brian’s Lawn Service does not impose an additional punitive early-cancellation fee beyond this reconciliation.
9. Canceling Automatic Renewal
Canceling automatic renewal is different from ending the current service term early.
A customer who cancels automatic renewal will continue receiving and paying for service through the end of the current 12-month term, after which the plan will end and no new annual term will begin.

10. Failed Payments
If a recurring payment is unsuccessful, Brian’s Lawn Service may pause future lawn service until the account is brought current.
Brian’s Lawn Service will make a reasonable effort to notify the customer of a payment problem.
11. Customer Property Access
The customer is responsible for providing reasonable access to all portions of the property included in service.
Gates should be accessible and pets should be safely secured when service is expected.
If an area cannot reasonably or safely be accessed because of a locked gate, unsecured animal, parked vehicle, construction, or another condition outside the control of Brian’s Lawn Service, that area may be skipped or service may be rescheduled.
12. Hidden and Unmarked Items
Customers are responsible for identifying irrigation components, landscape lighting, wires, hoses, toys, invisible fencing, drainage components, low or concealed objects, and other property features that may not be readily visible during normal lawn maintenance.
Brian’s Lawn Service will exercise reasonable care while servicing the property but is not responsible for damage to concealed, improperly installed, or unmarked items that could not reasonably be identified during ordinary lawn maintenance.
13. Changes to the Property or Service Scope
If construction, fencing, a pool installation, landscaping, property additions, or other changes materially alter the amount or difficulty of lawn maintenance required, Brian’s Lawn Service may provide an updated quote.
Additional services requested by the customer may also be quoted separately.
14. Renewal Pricing
Unless Brian’s Lawn Service provides notice of a different renewal price and the customer affirmatively accepts that new price, the customer’s existing monthly rate will remain in effect for the next renewal term.
If a proposed price change is not accepted, Brian’s Lawn Service may allow the current Agreement to end rather than renew it at the new rate.
15. Electronic Agreement
The customer agrees to conduct this transaction electronically.
By checking the required agreement box during checkout and completing enrollment, the customer acknowledges that the customer has had an opportunity to review this Agreement and agrees to its terms, including the recurring monthly billing obligation, 12-month service term, automatic renewal provision, and early-termination reconciliation.
The customer should retain a copy of this Agreement for their records.
